(Querist) 27 September 2012 This query is : Resolved
What action is taken by a JrDiv.Judge,if a Sr Citizen aged 80yrs writes letter to judge, about harassment by multiple litigation narrating the facts with photos etc.? He is Cardiac patient... Please guide. He has mentioned his address and other details.
Kiran Kumar (Expert) 27 September 2012
What is the purpose of writing such a letter?

the judge should recluse himself from all his cases, such a conduct will rather be considered as a contempt.

if the person being a senior citizen is having any grouse then he shall adopt a proper channel.
R.K Nanda (Expert) 27 September 2012
judge cannot take any action in this regard.
V R SHROFF (Expert) 27 September 2012
Age is irrelevant in cr proceeding.
Judge will not consider any direct/ personal letter written by Sr. citizen. He can aply in court proceedings, and order can be passed on Exhibited Appli.
Rajeev Kumar (Expert) 27 September 2012
Judge can't pay heed to your letter and can not take any action. If you are aggrieved the file appeal.

prabhakar singh (Expert) 29 September 2012
You should not communicate personally with a judge, your age has no bearing ,you can file all things in case file alone if relevant to your dispute.
AAVADHOOT. D (Querist) 29 September 2012
Thank you Sir, He is my neighbour.an old person.
prabhakar singh (Expert) 29 September 2012
Still officially you should not.every one is gifted with 2 ears but only with one mouth.Judges have role of hearing so they can hear others'mouth.understand?
AAVADHOOT. D (Querist) 29 September 2012
ok. Yes Sir.
Raj Kumar Makkad (Expert) 30 September 2012
Such practice is not tolerated in Indian judiciary what ever circumstances may prevail. It is better to plead all such facts in the court when file comes before the concerned judge to hear.
Raj Kumar Makkad (Expert) 30 September 2012
otherwise also, my learned friends have given much time to deal your query so refer to their replies also.
AAVADHOOT. D (Querist) 30 September 2012
