foreign service provider

can i take credit of service tax paid by me on behalf of a foreign service provider not having office in india.are there any case laws on this issue?

dear,
this is a controversial issue till date. as the consumer is paying service tax on the services received by him. and only those persons can take credit who are provider of services. as you are not service provider in this case. so you are not eligible to take credit of service tax paid by you.riven
