Reg refusal of promotion

In govt. service there two types of status one is ministerial and another is executive. If one ministerial Gr. B Gazetted officer is promoted to ministerial Gr.A gazetted officer and he refused to accept the promotion as he is willing to accept promotion to Executive Gr.B Gazetted post ( there is possibility of promotion to executive Gr.B Gazetted post) then can the department initiate disciplinary action against him for not accepting promotion ?

Please clarify.

Pehaps you could clarify the facts better I could only understand your query on feasibility of disciplinary proceedings.

Yes. refusal to accept promotion is not a right it is a concession. If such request is turned down disciplinary action can be taken.

Promotion when due can be made only in the line of promotion, as per the recruitment rules, not to the post as may be desired by the employee. Of course, refusal of promotion is taken as indiscipline on the part of the employee for which disciplinary action can be taken against him.
