If a person takes benifit of sec 12 probation act then will it effect the mact and consumer cases.

This student of class11th age 18 years holding a learners liscense,had an accident, coliding with another car on the other side of the road.in july2008.opposite party suffered fracture of knee.fir lodged by opp party.279,337,338 ipc and134,187 Mv act.insurance refused claim. Filed in consumer forum. Opp party filed a claim in MACT. At present student has to go out for studies, therefore we want to avail sec 12.
