Wrong allotment of trade in indian air force

(Querist) 27 June 2012 This query is : Resolved
sir, i was enrolled in air force in 2004.during my enrollment medical examination medical officer remarked that i am fit for all trades except AFSO trade.but after completion of basic training due to some clerical mistake or reason not known to me i was allotted afso trade. allotment to afso trade is acceptable upto a vision of 6/12 without glassses correctable to 6/6 with glasses. at my enrollment time my vision was LE 6/36 and RE 6/9 correctable to 6/6. i was not aware of all these facts. i paased out as an afso tradesmen.due to vision related jobs i got extra pressure on my vision and my eyesight deteriorated to 6/36 BOTH EYES but still correctable to 6/6.now i was feeling itching like problems in my eyes on during duties. so i reported to an iaf eye specialist. he told me that u should have not been allotted that trade and he recommended me for change to a suitable trade. my application in same regard is under process.now a same case came in my knowledge in which change of trade request was turned down saying that your eye sight is still 6/6 with glasses.sir, if same happens in my case ,can i go for a legal help and what are my chances. further appointing a lawer will put a financial burden on me, can i claim for that. and administration has taken an undertaking from me like i will not leave service for a period of seven years after re-mustering which not acceptable to me and many other points. sir it is unjustice because i was nowhere involved in wrong allottment.i m trying for several civil posts for betterment of carrer.now what positive can be done in my case, i want my trade must be changed. i have all intial mediacl documents and correspondence made regarding that application. sir please suggest some efficient lawers dealing such armed forces cases. i will be thankful to u.jai hind.

Since 2004 you hve spent half of the career as ariman and wwith deteriorating eye sight you may be LMC till you are able to get to the rank of Cpl. That means you are not getting promoted. I do not know how you are managing annual medicla check and none has recommneded change of trade.

You hae not stated whether at all you have represented against akkotment of this trade against medical advise. You cannot be having a cake and eat it too.

If you would have represented you could have even gone to court.

sie thanks for the time you spared for me.but i could not get full meaning of ur reply.however as i understand this i explain it. 1. me myself have put up application for change of trade after the matter came in my knowledge. 1. i have copy of intial remark stating afso trade should not be alloted to me. 2. copy of currrent recommendation of optho (armed forces) stating unfit for afso trade and stating that initial allotment was due to clerical mistake. 4.as far as annual medical is concerned it was not being done of personnel having service less than 9 year.last year it was annonced that all have to get annual medical check.thats why i was not having any reason to puruse initial medical document. 5.this year i first time gone through amc they declared me a4g1(fit one) category becuse it was quite formal without checking any damm thing.before that i have already applied for change of trade based on documents mentioned in point 2 and 3 .6. promotion - right now i m cpl and there will not be any problem in further promotions in new trade as i m unfit in present trade but fit in many other trades.thats why i want to change my trade bcoz every time medical will not like be like this and my promotions may be stuck on a later stage in present trade. further my present trade comes in critical one and in new trade i will have opportunity to apply for claas II jobs.now my query is can i take legal help if they dont change my trade bcoz a same application of somebody was turned down by afro stating that you have 6/6 with glasses.where as iap says for afso vision m should not be less than 6/12 and with glasses 6/6. i hav 6/36 both eyes and with glasses 6/6 and what are my chances if i seek a legal help. further can i claim for my legal expenditure. further can a medical pension bais discharge can be taken on this wrong allotment basis. your advice is valuable for me
