Sale deed issues

Sir,

We had purchased a flat of 28 yrs old in hyd. when we had went to SRo for registration we were told that we need a NOC as the property is coming under ULC.
Now we have got the NOC clear now, but the cheque no. is expired as it crossd 6 mnts.So wen went for a rectification deed now with new cheque no.
Now the real problem is that the vendor need to give 6 lacs back to us which is paid in excess already. But vendor dont want to pay the 6 lacs to us before he gets his cheque encashed.
Problem is that i m not sure if i get tha amount that i m supposed to get from vendor. So i am asking for a guarantee or pay amount before i handover the cheque.

Please suggest.

issue a demand draft in favour of seller if seller is reluctant to return the money paid in excess . you have stated seller wants to get his cheque encahsed before returning excess payment . show him DD of nationalised bank .
