Property -deletion of name

i have property in the name of father and uncle,now we are separated from joint family of uncle, now i want to delete 2nd holder name(my uncle) in property how i can do it?
please tel me the exact procedure as per law

and also guide me what is the implication as per income tax

You have not mentioned the nature of the property. I am asking this question because the procedure of partition of properties is different. If property is only agricultural land then file partition application with Tehsildar and if the same is other than agricultural land then file civil suit for partition and possession.

There is no stamp duty in case of partition of agricultural land whereas stamp duty is leviable in civil suit.

what is the nature of property. If it is joint property or ancestral property. Get partition and if it is self acquired, the person, in whose name is property is the absolute owner

Give the documents supporting the partition of property between your father and your uncle which gives exact title to your father so that your uncles name seen in the patta can be deleted.
