Please give any ruling in this aspect in an FDP proceedings IA u/o 39 Rule 1 of cpc is not maintainable

It is duly maintainable. If any party to partition changes the nature or ownership during the pendancy of final hearing then it shall definitely increase the multiplication of the litigation so interim stay application is duly maintainable.
