Querist : Anonymous (Querist) 04 January 2012 This query is : Resolved
Hi, My husband has ancestral property means his grandfather's property. And,
he has invested his personal money on that
property. He has father, mother and one
elder brother. By going through law,
how can we get our shares? And, Is there possible way to get our personal investment also?

M.Sheik Mohammed Ali (Expert) 04 January 2012
if you willing to want to share, then all the member made the partition suit, and your husband spent money on the property if you have proof then claim.

As advised by Mr.Sheik, you can file a suit for partition of the property.

If it is ancestral property then all brothers and sisters of your husband along with their father are coparcener of the property in equal share and accordingly your
husband can claim his share, the investment in improvements by your husband can also be claimed in allocating that part as his share
provided he pleads and proves that the same was made exclusively by him with understanding of all that at the time of partition such adjustment shall be allowed to him.

Yes they have equal shares in the property which they can enforce in case of dispute through a partition suit to be filed in the court of law.
