Respected Sir,
My father have some land from my grandfather. This assts are oral partition from grandfather ( oral part his life time – grandfather) . My father having two elder brothers (so 1+2). Now my fathers one elder brother was died. Still that assets my grandfather name. Now my father want to gift the land to me. My questions.
1. The name transfer to my father name that time his elder brothers Signature need or not.
2. The alive elder brother will not come
3. But another brother son’s ready support to us ( brother died)
Please provide safer legal for this land.

In the given matter, partition and possession case should be filed so that entire problem under one go may be resolved.

Your father needs to get the partition/ possession of property legalised as advised by Shri Makkad and then go for gifting exercise, otherwise disputes can arise any time later also.
