I done sale agreement b/w me & vendor with token amount of Rs. 1lack as advance.Now I want to cancel the sale agreement and take my token amount back as Title is not clear but vendor refused to give token amount back stating that he has clear Title (though his title is not valid & clear) & more over time of agreement also completed and there is no need of giving money back actually as per agreement.But finally vendor agreed to give amount back by putting condition that if his Title proved as unmarketable till then he doesnot give any amount refund.I want to settle the matter out of court for fast & less expensive.So i decided to solve this in Lok adalat.
But i have some doubts
1) since we both are ready to settle 1 lack in out of court & with our requesting application to lok adalat for solving this prelitigant case, it is possible for Lok adalat to conduct proceedings on said property inorder to come to conclusion on bonafide of vendor title with available evidence because vendor also ready to give amount if his title proved as un marketable & vendor also agreed stands on final award of Lok adalat.
