Name transfer regarding

sir,
my father brought one house in his name under govt loan in housingboard.(self acquired property) my father passed away,me mother sister,grandfather and grandmother are the legalheirs of my father,my grandmother and grandfather also passed away.
my question is,
1.how to change the property into my mothersname?
2.whether the legalheirs of my grandfather have any role in my fathers property?
3.whether the legalheir of my grandfather want to sign in NOC certificate?

Dear Mr.Raja,
In regard to your deceased father, only his mother (i.e. your grand mother), his widow (your mother) and his son(you) and daughter(your sister) are the Class-I legal heirs entitled to inherit the property.

Since your grand mother has already passed away, the property has to be inherited only the three of you i.e. your mother, you and your sister.

In case you want the property to be mutated in your mother's name, then you and your sister have to give a Registered Relinquishment Deed (relinquishing your respective interests in the property) in favour of your mother.

On the basis of the said Registered Relinquishment Deed, the property will be mutated in your mother's name. Thereafter your mother will be the exclusive and absolute owner of the property.

There is no need for any other document like NOC etc., from anybody else.

i agree with our expert R Ramchandran and Rajkumar Makkad. but if it is possible thorugfh the office of the Registrar the n its better. by filing the legal heirship certificate and consent affidavit the work can be done in the Registrar office. try or else as said by our expert
