Release deed

Querist : Anonymous (Querist) 14 August 2011 This query is : Resolved 
A land was bought on my name and my sister's name by my father when we were child.
Now, we both attained age around 40 and 45.

Two years back, my sister received some money from me and made a unregistered release deed in a stamp paper, mentioning that she releases her right in the land to me for the money she got from me.

Now she demands her share from the land, saying that unregistered release deed has no validity. Is it correct as per law?

She is absolutely right. Unregistered Release Deed has no validity in law.

well your sister is smarter than you . did you make payment by cash or cheque .

yes the Q of validity is zero but if she write the release deed with our hand and thumb impression was mention on it or the witness of deed are in the favor of you and if you are given money by cheque then court will consider your document but it is depend on the cross examination of your sister by way suit.
