Document Validity !

(Querist) 04 August 2011 This query is : Resolved
We found one legal GPA Document in our old house (tiled roof house) , which was not stored in right place and document has bit spoiled with rain water and lot of dust.
this GPA document was made in the year of 1994 and it has our Late grandmother's thumb impressions on all 4 pages.due to rain and dust Thumb impression has very less visibility, but the attested persons signatures and Seals are clear. we submitted this GPA document to Civil Court for one of our Civil case. does anybody know, how Court will treat this document, because of Thumb impression has very less visibility?

Do we have any court Judgements or act that has same type of scenario?

Now you cannot use that GPA because after the death of the executor of GPA it looses it's validity.

it is depend on the use of the said expired GPA. IT IS NOT CLEAR FROM YOUR QUERRY,what is the purpose of submitting it to the court. As far as existence of document is concern court must believe on it and you need not to prove it because it is a 30 year old document.

I do agree with sarin.
Advocate Rajkumarlaxman (Expert) 04 August 2011
AS said Sarin sir, it depends upon the use any document can be relevant unless and untill it is denied by the court itself. you cannot decide the same. hence your document has validity untill and unless it had been revoked by the executant during his/her lifetime only. but has mentioned of what is the gpa and why it has been placed in court purpose????????????

The document is not 30 years old. It is only 17 years old.(2011-1994). The POA can however be relied on to support any act done by the constituted attorney (CA) during the life time of the person who gave the power. For instance any agreement or sale deed etc executed by the CA during the life time of ur grand mother. The Agents power ceases on the death of the person who has executed the POA. As regards proving the document, if it is Notarized, the court may accept the document. The burden of disproving it will be on the party who denies its validity.
