Can it be a u/s 420 case

we have a HUF account ,due to dispute between the five co-parceners(all five co-parceners are there in income -tax also), the HUF account has been ceased by the other four co-parceners and now one of the co-parcener in HUF account has managed to open the HUF account in private bank with the help of private bank officials and when we came to know about that we made a complaint in the private bank and private bank ceased the account as in that account there was not signatures and other ID proof of other four co-parceners and the bank officials doesn't told us about the transaction details in the account and they told us to go to court .Sir , you are requested to tell us that a case u/s 420 will be registered on bank and as well as the co-parcener who has opened the account illegally.Sir , also we have a income tax refund check which can not be credited due to ceasing of account in first bank and the same ammount of income tax refund has been credited in the private bank.
