Muta marriage under Muslim Law:

(Querist) 06 March 2009 This query is : Resolved
Muslim Shia law recognize muta marriage, which can be for one day a week etc. Now if the said marriage continued without proper marriage and the couple live as husband and wife, can it be a valid marriage?
PALNITKAR V.V. (Expert) 06 March 2009
Is there any time limit regarding the validity of a muta marriage. Does any provision say that the muta marriage will be valid only for certain period.
Adv.Shine Thomas (Expert) 07 March 2009
Muta marriage does not create mutal rights of inheritance.
N.K.Assumi (Querist) 07 March 2009
It appears that it is something like a contract like cohibitation agreement, and at any rate there is no solemnization of marriage. Now, if the couple starts living together as husband and wife after the period of their contract, whether it will be valid or not is my query. And whether children born of such marriage will be regarded as bastards or legitimate child though there was no solemnization of marriage.
Adv.Shine Thomas (Expert) 13 March 2009
The marriage has no validity after the period of contract but the child bourn out of this wedlock is legitimate.

I do agree with the valuable opinions of the learned members. Thanks all of you.

Muta Marriage is dissolved ipso facto by the expiry of contracted term. After that the marriage has no validity.
