Querist : Anonymous (Querist) 10 April 2011 This query is : Resolved
I am from Mumbai but married in Kochi. My husband and other inlaws are harrasing me and torturing me mentally. They boast of status but can't even keep a domestic help and I have to do daily coras of hose hold from 6am to 11pm.

My father is aware of all these thing and wants to lodge a criminal case in Mumbai u/s 498 a. against them.

Pl. advice if it can be done in Mumbai although marriage was solmanised in Kochi and how we recover our ornaments and other money paid to them in cash and by cheques.

Pl. help us as my father is worried about my safety.

FIR is lodged where the offence had taken place, thats why you should lodge FIR in Kochi. if you want to take action from mumbai, you should proceed under Protection of women from domestic voilance act, 2005. under this you can recover ornaments and other articles also.
But first try to make understand your husband and in-laws and try to settle the matter.

you can file a criminal case under section 498a at Mumbai and also file a case u/s 406 IPC for recovery of your stri dhan(ornaments and gift given by your parents friend and relatives and ornament and gifts given by your husband, in laws and relatives of your husband.)and you als file a suit in mumbai under domestic violence act.

The complaint can be lodged in ether of the places if any of the incidents had happened at that place. It is not necessary that every offence must occur at the place whether the complaint is lodged. Once the FIR is registered it is the duty of the Police to recover the article , ornaments from the accused person and from their place of residence.

498 A complaints can be filed at place having cause of action as it is a crime which to be investigated by authorities within jurisdiction
