Eligibility to appear;

(Querist) 22 January 2011 This query is : Resolved 
1) i am a student of llb, i want to know who is eligible to appear before Various TRIBUNALS like Income tax, sales tax, Securities...?

2)an advocate want to do deal with above matters, does he need any extra qualifications...?

2. No additional qualification is required. But additional experience and knowledge is required to succeed in the case.

A party or his authorised agent or his counsel can appear before the said authorities.

An advocate enrolled under the provisions of the Advocate Act, 1961 can appear before any court, authority or tribunal by virtue of provision contained in section 30 of the Advocates Act, 1961.


"30. Right of advocates to practise:-Subject to provisions of this Act, every advocate whose name is entered in the State roll shall be entitled as of right to practise throughout the territories to which this Act extends, -

(i) In all Courts including the Supreme Court; (ii) Before any tribunal or person legally authorised to take evidence; and (iii) Before any other authority or person before whom such advocate is by or under any law for the time being in force entitled to practice."
