Buying a house, with tenant (Mysore, Karnataka)

Querist : Anonymous (Querist) 03 September 2010 This query is : Resolved
Hi,

I have agreement of sale with the owner of the house in mysore. First floor of the house has been let out for rent (from last 12 years) with agreement renewed every 2 years.

Now the tenant is refusing to vacate the house.

What are my opinons, to

1. Register the house in my name and get the ownership of house, without tenant consent?

2. Recover immediate possession of premises by court order (eviction)?

3. How safe it is go ahead with sale agreement?

Thanks for the responses and apprecaite your guidance.

1. You can finish the sale deed. No consent is required from the tenant. He has locus standi to interfere in the matter.

2. You have to find out or make out valid grounds for eviction of the tenant from there.

3. It depends upon your capacity and ability to decide about this issue.
