registration for new epf code for any establishment

sir,

i am working in national hydroelectric power corporation. we need some vehicles on hire and as per the tender documents epf code is required for qualifying the tender conditions . can you suggest whether epf code is necessary for the service provider whose number of employees is less than 10

as per provisions under the EPF & MP Act, it is not compulsory to get code no. if no. of ees. are less than 20. but can be obtained u/s 1 (4) on voluntary basis. however if it is compulsory clause to allot tender to a service provider to have pf code no., then it is advisable not to hire such firm as contract will become void. in case the condition is not compulsary, such firm can be hired but EPF act will have to be followed by the hiring co. i.e. principal er. for deduction and deposit of pf in respect of such hired ees.
