What will be defence for a man if he doesnt want to give maintanance to his wife.becoz the dv case is 100% fake.

You can not deny to pay the maintenance to your wife till divorce.There is no link to false DV case to maintenance case.

You can't deny from maintenace to wife on the ground of fake DV case subjected to proof. Maintenance is the right of your wife and you can file divorce on the ground of cruelty if DV is proved fake though in this case you have to pay maintenance too.

Maintenance is the right of a wife if she is having no income to maintain at par with the husband.

If i dont pay the maintanance in that case what will happen?becoz i want to keep her and her family dont want her to send with me beoz they only want money?there plan was to kill me giving poison after having two kids i have the recording with me?is that recording will help in court or not?

If order of maintainance is passed and you do not pay then, you may have to go to jail or your salary attached. You can file the recording in the court, however, you will have to prove the same.

Agree, if the order for maintenance has been passed by the court you should follow it and present your case with proof before the court.

Dear Sujith
you have to prove that she is earning and able to maintain herself. secondly if the court pass an maintenance order in DV case and you don't pay the maintenance, the court have power to issue a non-bailable warrant against you and in this condition this offence is non-bailable offence and the punishment is for one year.

my salary is 10000 and after deduction i am getting 7000 if the court order for attaching my salary i will resign from the job.i am ready to go behind the bars but i wont pay any single penny becoz i am innocent in this case.now a days law is with the ladies.she married me fo my money not for living with once when i checked her mails i saw she adjusted her date of birth according to the males date of birth and now also i dont know her real date of birth.
