THEY TELL ME TO DRAFT A LETTER FROM ADVOCATE AND ALSO DULY NOTARY AND SUBMITTED IN THE COURT. YOU WILL SUCCESSFULLY GET BACK YOUR PHONE. CAN U PLZ TELL ME EXACT PROCEDURES AND ALSO GAVE ME SAMPLE OF LETTER WHICH I HAVE TO NOTARY.

This is not first case of police. Contact them and they daily repeat the procedure.
Send them advocate's notice only if you never want it back.
You will get it only as a temporary custodian. As long as case is filed you are not having power to sell/gift the same and have liability to bring it to court on every date. If charges are proved against thief the phone belongs to you or if the charges fail you are liable to restore it to him.
