Divorce for muslim couple

sir,

as per the muslim custom we have taken talak, now want to go abroad we need valid divorce from court of law, kindly help me how to take valid divorce form the court,

should i file the divorce petition in the court ?

yoour talak is valid if it has been obtained as per muslim customs . you dont need divorce from family court

How you have taken talak. Do you have certificate from Qazi?

file a suit for declaration before civil court for dissolution of marriage due to talaq.

In the absence of a cause of action, suit for declaration will not be entertained by the court.

Interestingly, experts are giving pieces of advice but querist is maintaining silence.

I THINK NO Govt. appointed or registered Qazi WILL ISSUE TALAKNAMA NOW OF A TALAK ALREADY TAKEN PLACE SOMETIME BACK.

Respected sir,
i belong to west bengal, here state govt appointed qazi for nikah and divorce.
