Hit and run/dies

Dear sir
one of my cousin 2days back made an accident,bike accident a man walking on a road died,my cousin had a major wounds,suddenly the village people hit him like any thing,police sent my cousin through ambulance near by hospital,he under treatment,what will be the punishment,kindly advice.

This is not a hit and run case. Your brother shall face the case under section 279/304A IPC. He should also lodge a criminal case against the persons involved in his beating but it shall not affect the case filed against your oousin.

Nothing can be opined at this stage about the ultiimate punishment which is maximum one year.

It shall be better if your brother do not lodge any case against anyone. It shall definitely increase his chances to take right defence in the case.
