Regarding 498a

(Querist) 28 April 2012 This query is : Resolved 
My wife has filed fir u/s 34/406/498a on 12/01/2012/. it has been more than 90 days and case has not been chargesheeted. I am on anticipatory bail. plz advice what to do

wait and watch . mere delay in filing charge sheet is not sufficent to quash your 498 A case . you are already on bail .

If you want to expedite the case then apply to the Magistrate for direction upon the Police to submit the Charge sheet.

All three sections are different in their own nature as specified in IPC.As you are on bail,wait till the chargesheet is filed and why do you want to expediate the matter?

Generally the charge sheet should have been filed maximum within 90 days.But there may be exception. Prefer an application to the court to dismiss the case on this ground.

Which state?

In Delhi it can be upto 3 years too.
