Litigation charges - not paying

Guest (Querist) 19 January 2012 This query is : Resolved
I had applied for litigation of charges to my husband. He didnt appear in continuous 4 hearings and the court passed the order for it for him to pay 60000. But its been 3 months but he didnt give me the amount. When my lawyer spoke to his lawyer he s telling he doesnt have money now.
What to do now? How to proceed for it?

you mean costs.

if court has awarded coosts he is duty bound to pay . if he fails to pay draw the attention of court to said aspect .the court will fix a deadline for hiim to pay

If it is cost imposed on adjournment then default shall not emerge in his arrest,as it can be added in cost of suit while drawing the decree by court.

However if order relates to litigation expenditure inclusive of interim maintenance or even adjournment cost, court if prayed, can make it's payment condition precedent to defence of husband..

Now you have to execute the order.
