WHAT IS THE PROCEDURE FOR OBTAINING A LEGALHEIRSHIP CERTIFICATE FROM TAHASILDAR IN KERALA.
CASE: MY SISTER ( A RETIRED TEACHER), IN THE 1st MARRIAGE OF MY FATHER EXPIRED ON 10/12/2006.MY SISTER WAS UNMARRIED AND HAVING NO ISSUES.DEATH CERTIFICATE IS AVAILABLE.SHE WAS HAVING A BROTHER ALSO WHO WAS REPORTED TO BE COMMITED SUICDE IN 1984 IN A RAILWAY TRACK NEAR CALICUT.THE DEAD BODY WAS IDENTIFIED BY THE WEST HILL, CALICUT POLICE STATION AND FURTHER PROCEEDIGS WERE NOT INITIATED FROM OUR SIDE FOR OBTAINING DEATH CRTIFICATE etc.THE BROTHER WAS UNMARRIED AND HAVING NO ISSUES. FIRST WIFE OF MY FATHER ALSO EXPIRED BFORE FATHER'S 2nd MARRIAGE . IN THE 2nd MARRIAGE OF MY FATHER WE ARE 3 BROTHERS AND ONE SISTER, ALL ARE ALIVE.MY FATHER AND MOTHER ALSO EXPIRED.HENCE ALL TOGETHER 4 LEGALHEIRS IN THE 2nd MARRIAGE OF MY FATHER, ALL ARE ALIVE.OUR SISTER IS HAVING A FIXED DEPOSIT WITH A CO-OPERATIVE BANK AND TREASURY SAVINGS DEPOSIT WITH SUB-TREASURY, TALIPARAMBU IN CANNANORE.NO NOMINATIONS ARE AVAILABLE IN BOTH THE CASES.WHAT IS THE PROCEDURE FOR OBTAINING A LEGALHEIRSHIP CERTIFICATE FROM TAHASILDAR?.(KERALA STATE)FOR PRODUCING BEFORE THE BANK AND TREASURY AUTHORITIES FOR SETTLING THE DEPOSIT CLAIM .WHETHER WE HAVE TO GO IN FOR SUCCESSION CERTIFICATE FROM THE COURT INSTEAD FOR LEGAL HEIRSHIP CERTIFICATE.

There is no provision for obtaining ridership certificate in WB.

You shall have to move an application supported with your duly sworn affidavit with the relevant document showing your link with the deceased like ration card, voter card or any other ID and after due verification the Tehsildar shall issue such certificate.

Verify whether any nomination had been made at the time of deposit with the bank before applying for legal heir certificate.The procedure pointed out for obtaining legal heir certificate is the right way.

The competent authority to issue heirship certificate is the Tehasildar. This is issued by him on application and after inquiry through his functionary about the facts mentioned by you in ur application.Pl note that this certificate is useful for limited purpose of effecting mutation of revenue records and the like. For purpose of claiming property of the deceased such as bank deposits etc, the banks will insist on succession certificate or Administrator Certificate. hence pl enquire with the concerned authorities and do the needful. Succession certificates are issued by Court; Administrator certificate is issued by the Administrator General of the State.
