Querist : Anonymous (Querist) 22 December 2010 This query is : Resolved
In a registered sale deed i'm not a party to that registered document.. can i in way ask for a declaration for that sale deed to be illegal, null and void???

It must be made clear how your rights are affected by the said sale Deed - How it is illegal - these facts to be considered by you for filing a suit for declaration of a Sale Deed as null and void -

* You are not party to the said Sale Deed - it is not binding on you - why suit for declaration of sale deed as null & Void !
Uma parameswaran (Expert) 22 December 2010
An aggrieved party can file.

Since you are not a party, you need not file such a suit at all.

If you have right over the property and some body else is illegally selling it, you can file a civil case for suitable remedy.
Y V Vishweshwar Rao (Expert) 22 December 2010
In case -You are in possession of the property as its owner and some one or any one of your other share holder independently sold the property with out your knowledge and with out you being party to the sale deed - you can file suit for declaration to remove the clouds created by some others/ or other share holders - on your rights /and/ property !
Pritam Saini, Advocate (Expert) 23 December 2010
