My wife bro declared thru affidavit that their younger batchllor brother died intestate hence his property,they are only heirs now he sold room and also died then affidavit binding on his heirs to distribute share of room to other heirs.

It is believed that deceased was Hindu.
Confirm.
The ClassI legal heirs i.e; Mother, wife, sons,daughters have first right.
If mother has predeceased the bachelor son then evidently ClassI legal heirs are not present.
ClassII legal heirs shall come into picture.
Who and how has sold the estate of deceased bachelor son is not clear from your query!

Mother,wife,son and daughter are class1 legal heirs. IN their absence class 2 legal heirs come into picture. First and Foremost the affidavit is not useful and wouldn't partake a will or registered gift deed. Hence Affidavit is not binding.
