Repost: nabbing a con-man

Hello all esteemed members,
Unfortunately, due to my greed I have found myself in a matter that I am incapable to handling myself and seek your invaluable guidance.
What is the correct way of confronting a person who is duping you? Said person has already swindled Rs.30 L in the hopes of selling me a flat before I was smart enough to realise I was being duped.
Only reason that con-man is still in touch still is because he is expecting more payments for the flat deal.
I am at my wits end and don't know what legal recourse to take.
I will appreciate all the help I can get.
If I am missing out on any information, it is only because I don't know what kind of information I should share.

You should lodge police complaint in the matter. If police is not lodging FIR file it through court u/s 156(3).
Consult a good local lawyer dealing in criminal cases.

While lodging complaint of cheating (Section 420 IPC) with the police, u should inform them all the documentary and other evidence u have to prove the crime. Take certified copy of the FIR recorded by the Police. This will be of use to u for filing a private complaint if the Police fail to take action on ur Complinnt.

Thank you Gupta Sir... I have made part payment in cash and part in white... I also have a couple of phone conversations and audio recordings where he talks about the deal.
I also have a cheque from him which is over the value of how much I paid him. He gave this to me so saying that it is 'security' and that once the flat deal goes through return it to him.
Is there any other information from him which would help us make a stronger case ..
