Neighbour as witness

No physical violence is alleged by petitioner. only mental torture / cruelty is the allegation. Neighbour is petitioner's witness.

what is importance given to a neighbour's statements as witness in a 498A or DV case ? there is no other evidence except a neighbour who claims to have heard lot of shouts/cries/noises/arguments.

The evidence is important if he could state something he witnessed.

I agree. That he heard s etc will be important to show that there was discord between spouses. Whether hubby is the culprit or the wife?

In a matrimonial cause where chances to evidence facts largely associates with spouses and/or their relatives testimony
of a neighbour would be of great importance
for whatever he successfully proves as an independent witness.
