(Querist) 06 July 2013 This query is : Resolved
Dear Sir/Madam,

Is the Unregistered WILL with THUMB Impression Valid.

My Mother written a WILL with duly SIGNED and same was registered in Register Office.

Am out of country now, my mother is with my sister and not in so conscious and she can not SIGN.

If my syster takes THUMB IMPRESSION of my mother and create fake unregistered WILL, is it valid legally.

Please clarify.

Sincerely
SAI SRI

If your other is literate as appears from her earlier wILL, THE SUBSEQUENT wILL WITH THUMB IMPRESSION WOULD BE TREATED AS INVALID.

no, it is illegal.
Adv Archana Deshmukh (Expert) 06 July 2013
You can challange the said will with thumb impression.

Challenging such a will of a person who used to sign is your right and establishing reason why thumb impression was taken is incumbent on your sister.
Rajendra K Goyal (Expert) 07 July 2013
There is enough grounds to challenge such a will.
