Dear sir
i travel in the express train,in general coach from salem to Coimbatore.i got set in the window side, after 10 mins when train moved, a lady came near me ,say that this seat is belong to her, but no supporting things is not found in her place, i said it is the general coach, every paty can seat in the place, it is not reserved coach so i can not give the place, suddenly she scould in the all bad words in front of other passenger,i have record the speach she spoked the lady with incident,
can i file case against her that she specked with bad words in front of the public in the general coach, it get insolent,
Please reply sir ,what to do.

This is a case u/s 500, 504 of IPC but you would need her name and address.
It is better to avoid such trivialities.It is a common place example in public places.

This is absolute case of Defamation under the civil and criminal law both. but you have to find out name and address of that lady.

forget it as bad exeperience . for filing suit of defamation you will have to engage a lawyer , keep on going to courts for number of years . you may not even have her address . how will summons be served?

Life is a journey,wherein we come across different kind of people at times at different places.Such things happen commonly with or without our involvement.Though it may be a bad experience in the midst of co passenger's,we have to forget at times.Mere recording of her outburst is not enough as a substantial evidence,and you do not know her whereabouts.

further i would like to add that if no body was known in that crowd, it does not constitute a case of defamation. AT least one should be there who says that in his eyes your reputation lowered after that incident.

Yes, you can file defamation case if any known person was present at that time. The case will be stronger if you can produce any witness.
By the by I have also faced such type of behaviour in upper classes in the said route i.e. from Ernakulam, Palghat, Coembatore, Salem, Chennai during my regular trips 5 years ago.

by now you neither have the identity of the suspect nor of the persons present there.
If you give complaint to police every now and then they will call you in local thana (where crime occurred) and request you to identify the suspect out of collection of some suspect women. These women will again abuse you.
If police is able to trace the lady (or even a fake lady) she will in just one moment take a defnece that she protected herself from you advances and you are ruined.
