Dear Sir, Details are as follows
Nov 2006 to 5th Dec 2009 - worked abroad
5th Dec 2009 - June 2010 - unemployed in india
July 2010 - Oct 2010 worked for 3 months in india
Oct 2010 - June 2011 - unemployed in india July 2011 - worked for 15 days abroad July 2011 to Nov 2011 - unemployed in india 4 Dec 2011 left for abroad on a two year contract. 2011 -2012 only 15 days income earned from abroad

2011 -2012 - 15days income in July 2011 from abroad + Dec 2011+Jan 2012 - MAr 2012 salary from current emloyment abroad.
will he get NRE tax benefit?

Since the income was earned outside India from his current employment aboard, there is no liability to pay taxes in India.

Dear Vishal,
Pl note indian gov is proposing to deduct tax on NRI income (Global income) subject to stay of an NRI in India for a period exceeding 60 days in a financial year and or 9 years stay in india preceding 10 year from the financial year or 7 year stay in india or 730 days.
My question is regarding whether my husband will get the benefit of NRI or will be treated as a "resident".

Madam the provision you are speaking is in the propasal stage and not yet enacted and hence it will be difficult to advise unless the income tax act is amended and the provision is included.
