Filing a case against person tarnishing my name

Hi, I want to file a case against a person who is trying to damage my respect in society. can you please let me know the following

1)how should i approach

2)Do i have to engage any lawyer for that. can i file case myself

3)what is the benefit which i should claim for

4)that person and me are staying in different cities ,can i file the case

5)what if , that person does not receive my case letter which i will send as register post

6)if i file the case in my city, do he has to come to my city and attend the case or do i have to go to his city and attend the case

7)how much time it will take

8)what are the proofs which i have to submit . i have some of my friends as witnesses . is it enough

9) what are the chances for my success.

10) if i fail in this , is there any chance for him to file a case on me ?

if some one is tarnishing your reputation by defaming you it is advisable to contact a local lawyer who after goin through the facts of the case will advise you .

you can after issue of legal notice by registered post file suit for damages . it will take around 20 years in bombay for suit to be decided

1 & 2. You shall have to approach a lawyer and have to follow his line of action.

3. You can sue for claiming damages as well as criminal case. Damage should be assessed by you upon which stamps are required to be affixed.

5. Court shall send summons and then bailable warrants and then non-bailable warrants through police and there are various other powers of courts in this regard. You need not worry about the procedure.

6. He shall have tot come if you file in your city.

7. 2-3 years.

8. All oral as well as documentary evidence, if any. Oral evidence of frnds is also a good evidence.
