Query on will

Querist : Anonymous (Querist) 01 September 2011 This query is : Resolved
We had a freehold property purchased by my father in year 2000. Out of my knowledge My father made a registered will in favour of my brother in year 2003. Than in year 2007, he made another registered will of same property in my favour without mentioning any description of his previous will in the new will. He gave me all property papers and the copy of his latest will to me. He died in 2009. In year 2010, having understood being owner of property, i sold it.
Now when my brother came to know that i have sold the property, he is demanding his share.

How can i safeguard my interests?
Who is the actual owner in legal terms?
Can my brother challenge me in court?
How can it impact me in terms of any penalties of selling it without taking consent of my brother?
Can court reverse the deal i made?

Yes, nothing to worry. If the second Will is duly executed then your brother has no case.

i agree with experts that second will revokes earlier will and that by will of 2007 you are sole legal heir to the property .

Where are you from?
Raj Kumar Makkad (Expert) 01 September 2011
Though there are no chance of reversal of things but definitely your brother is not having the knowledge of subsequent will executed by your father. he can go to court and may challenge sales made by you and you shall have to defend litigation. It is good to sit with your brother and settle the things amicably instead of increasing enmity in the name of some property.
