Its out of court proceedings. Court will not interfere with out of court settlements. If your husband file the petition for divorce mean you have to proceed further. If you not willing to give divorce mean have to contest the case. For your litigation expenses you can file interim maintenance,.

In case you are also ready to give divorce mean both of you can file a mutual divorce petition.. Same time both of you can make out of court settlement about your alimony.. Thats it.

on what grounds has he applied that marriage bed eclared as null and void .

did you not raise this query earlier?
prabhakar singh (Expert) 22 November 2011
It is not your parents who have any right of compensation against the petition filled.
As suggested by Mr.Tom you can,however seek
maintenance and also file DV case or s125 Crpc case.

It is not clear on what ground your marriage has been sought to be declared null and void as asked by Mr. Sethi;
or your husband has simply filed a divorce case???????

You have prove your sufferings and damages out of the misdeeds of your spouse, then only suit for damages stands.

It would depend upon the court's descrition.

If you are at fault, you can get little, however if hubby is at fault, you can gain a lot.
