498A & 406 was transferred by Highcourt on the application of complainant from CJM Court to another court of JMIC but within the same district.At the time of submission of charge sheet & application there was no court in the town were alleged occurrences of offence has taken place.Now as by 13 FC new court of JMIC has been created in Town were alleged occurrence has taken place.
Now my query is can JMIC court transfer this case to the court created in the town were the occurrences has taken place as the New court of JMIC has been created their.
Almost all PWs have been examined.
The early order of Highcourt of transfer from CJM court to JMIC Court has taken place 2 year before the creation of the new JMIC Court.

the lower court have no power to transfer the case, you have to file transfer petition before HC again.
