One of my known insist me to ask me the ques.
one person is accused in ndps act with 22/61/85 sections he is in jail from 3 months not getting bail....
any chances for him to get bail in this sections ....????

Grant of bail in unbailable offenses is not right of accused but discretion of court and opinion about grant can be formed from case brief,the FIR and case diary.
It is surprising that a house wife is accused of NDPS?

so u said it is very difficult to obtain..bail.......

Under the said act, the charges under the referred sections except section 85 (which is unknown to this act), the punishment under conviction may vary from 6 months up to 10 years rigorous imprisonment with or without the fine amount, hence getting enlarged on bail within one or two months will be difficult, however an application for bail may be moved before the high court where chances to get enlarged on bail are brighter.
