(Querist) 10 June 2014 This query is : Resolved 
1.Is it the owner,who is liable to pay property tax, Generally OR The Tenant?(state =Andhra Pradesh)

2.If the Lessor already agreed with lessee to get back property tax reimbursed, Who is liable?

3.Now if lessee denies to pay, even after agreeing initially(point 2 situation),in 11months lease unregistered deed of shop, what is the remedy to me??

Please show way,as,my tenant Rises his voice and always goes in arguments and also disrespect, by saying, he ll issue notice of advocate,
I just inherited few months back on account of death,
HOW DO I TACKLE MY TENANT, pls help Experts.

Normal course the owner pay the property tax. Otherwise the lessee pay and adjusted the same. If lessee not accepted the term then show the way. It is not big issue. It is your property and ask to vacate the premises. Act immediately.

liability of payment of property tax is on landlord . file suit for eviction if you dont want your tenant on account of bonafide requirement

Property owner is liable to pay property tax, not the tenant, unless otherwise agreed in writing by the tenance to bear with the tax amount.

1. Owner of the property.
2. The adjustment is between two parties.
3. If the tenant agreed to pay the property tax and failed to pay, you ask him to vacate as this is in violation of the agreement.

Tenant is taking advantage of your weak position. You should assert on him by involving commonly known people and settle the matter amicably. If you resort to legal action immediately, it may not be possible to get the shop vacated. Hence elderly involvement is necessary initially. Otherwise, you can engage an advocate, who can prepare and serve eviction notice on the tenant.

The owner only is liable to pay the property tax. You may follow the advise suggested by expert Mr. Malipeddi Jagga Rao for proceeding further on the issue.
