Jurisdiction of dismissal cases.

What is the jurisdiction in dismissal cases for executives in Central PSU.Can writ be filed in home state rather than the state in which one was working .Any rules or rulings for the same.Kindly advise if 100% jurisdiction is there in home state high court.

It would be filed in the court where the person is posted at material time.

Doesn't the high court in his place of domicile come under jurisdiction when the dismissal has been served at his native.

The High Court in whose jurisdiction the person was employed while dismissed has the jurisdiction.

It means that if the person was working in Kerala,he has to file it there even though he is from Uttarakhand.It seems illogical.Kindly suggest some measures legally.

The Kerala High Court by the decision dated 28/6/2013 [Selvin Abraham v. Punjab & Sind Bank) has held that in case of an employee working in Coimbatore (TN) and order of dismissal also passed there, but communicated to employee while residing in Kerala, the Kerala High Court has jurisdiction to entertain the Writ Petition.
