Can any person transfer the case from lower court to High court in 138 case.

No. He cannot do so as the powers of the courts are well defined in law.

If such kind of rights were to vest in litigants then why judicial system were
there in need. Such functions are governed by legislation and vest in court.Transfer right at district level vests in District Judge,for enter district it vests in High Court and for enter state,it vests in Supreme Court.
