Dear sir
my family shifted from bihar to andhra pradesh while i was a kid for employment. we belong to BC caste in bihar but our cate does not exist in andhrapradesh. i need OBC for educational purpose. my parents dont have caste certificate and they have not made a birth certificate for me as we are from small village and my parents are uneducated.how can i get an OBC certificate.

You can get the OBC from Bihar,which could be used for securing employment in Central Government.In respect of Andhrapradesh, you can get it if the caste is declared as a Backward in AP.

Better esquire from the collector's office the procedure to be followed by you to get the caste certificate, when your caste is not declared as BC in AP. Find out whether the Gazette notification issued by the Bihar Govt declaring your caste as BC would be sufficient to get the certificate in ur case.

To me Mr.Isaac Gabriel has squarely dealt with your query.
True that cast certificates are issued by DM/SDM on report of tehsildar and lekhpal.Also true you can still get birth certificate.
But query got completed by answer of Mr.Isaac Gabriel.

I believe he cannot have caste certificate from two states because such certificate is issued on the assumption that he is "ordinary resident" of the plce in terms of Representation of Peoples Act.

Mr.Isaac Gabriel has not asked him to gain cast certificates from two states.
His answer may be re read please "You can get the OBC from Bihar,which could be used for securing employment in Central Government.
In respect of Andhrapradesh, you can get it if the caste is declared as a Backward in AP."
that means the cast certificate issued by Bihar shall be of use in AP only when AP also recognizes that cast as Backward one.simple!Is not it?

Thanking u all for valuable advice. may be i did not present the question in a clear way. i know that i should get the caste certificate in bihar only and not in andhrapradesh. i did not know that i could still make my birth certificate. can some body please explain a little bit. i mean i dont have any certificate proofs to prove i was born there.my parents dont have their own birth or caste certificates.how to proceed to obtain birth certificate and on that basis caste certificate.hoping for kind assistance.

Mr.Sunil, as it is already clear to you, you have to make efforts in Bihar for your caste certificate. That may be possible if your parents have any ancestral links with that village. Your blood relatives can help you in getting certification of your caste by revenue authorities. But the task is not so easy as you are not residing there presently. Make an effort in this direction.

Subject: Issuing of Other Backward Class Certificates to migrants from other States/UTs

In continuation of the DOPT's letter of 36012/22/93-Estt. (SCT) dated 15 November, 1993, I am directed to say that it has been represented to this Department that persons belonging to OBCs who have migrated from one State to another for the purpose of employment, education, etc. experience great difficulty in obtaining caste certificates from the State from which they have migrated. In order to remove this difficulty, it has been decided that the prescribed authority of a State/U.T. Administration in terms of the DOPT letter No.36012/22/93-Estt.(SCT) dated 15th November, 1993 may issue the OBC Certificate to a person who has migrated from another State on the production of a genuine certificate issued to his father by the prescribed authority of the State of his father's origin except where the prescribed authority feels that a detailed enquiry is necessary through the State of origin before the issue of the Certificate.

2. The Certificate will be issued irrespective of whether the OBC candidate in question is included in the list of OBC pertaining to the State/U.T. to which the person has migrated. The facility does not alter the OBC status of the person in relation to the one or the other State/U.T. The OBC person on migration from the State/U.T. of his origin to another State/U.T. where his caste is not in the OBC list is entitled to the concessions/benefits admissible to the OBCs from the State of his origin and Union Government but not from the State where he has migrated.

3. It is requested that all competent authorities may be advised to issue the OBC Certificate after satisfying themselves of the correctness of the Certificate. The Lists of the Competent Authorities empowered as per DOPT's circular of 15 November 1993 may be followed strictly. No other authorities may be allowed to issue the OBC Certificates.

thank you Mr Isaac gabriel and Mr malipeddi jaggarao for the assistance. As i have pointed out that neither i nor my parents have necessary documents to prove as required by the circular attached by Mr Isaac gabriel. as pointed out by Mr Sudhir Kumar can I still make my birth certificate and on that basis caste certificate. Is it correct?. For the information we still visit our village often and my relatives have houses over there. Will that be in any way helpful.

The GOI circular reproduced by Shri Gabriel clearly lays down the procedure to be followed by the State Govts. As your relatives are still living in the village of your origin an affidavit from them stating that your father belonged to the village and is related to them and that he had migrated to AP for livelihood and that their caste is listed as OBC in Bihar. You father can apply for the certificate supported by such an affidavit to the prescribed authority of Bihar. Set the ball rolling; you can find solutions if any further requirements are there.
