Sir
i am married in 2005 my husband deserted me with a 2 yr son in 2009. i have filed the case of conjugal rights against divorce case under mental torture filed by my husband.
As for maintenance for my son and me the district court has ordered him to pay 15000 rs every month and for the same case to enhance the alimony i have filed a case in high court. but now when he is not ready to reside with me case under DV or 125 i have to file because he left me to my native place with the promise with my father that he will come and took me back after 15 days.i have filed sec 125 crpc. but in short period of time how can i get the relief and i just want to come out of these cases and want to live life peacefully with my son.

go for compromise for one time settlement, if your husband agrees, withdraw your cases.

its better to settle the matter amicably...seek help of your elders and family members....make proper discussion with the other party in order to put an end.

however, if the other party retains the adamant attitude then dont compromise, let the lis to continue.

Mr.Kiran is right.Your husband too should volounteer for an amicable settlement,otherwise both of you have to run around courts shelling down tons of money and time.

When your husband is not ready then only option for peaceful living is to shun the cases which is not possible for you.
So learn to live with the cases pending so far.

thanks for giving your time. my husband is paying 15000 per month to me and for sufficient amount he is not ready for settlement. i want to live with him but he is not at all ready for compromise.i have filed sec 125 only after asking his consent whether ready to join or not.he flatly refused.

hen file suit for restitution of conjugal rights.
However martial life can not be forcefully lives unless both parties are so willing.
