Notice period

Hi Sir

I was working in an IT company.Last month my manager asked me to resign and look out for a job. But I did not.Within a month He made up false case about my performance. Hr gave me a warning to improve my performance. then they started harassing me. So I resigned on 23 august . In my resignation email i wrote that i would be serving complete notice period of 2 months and wrote my last date in company after 2 months.

But after 2 days (25th august0. Hr came and asked me to leave the company. I asked that I should be given 2 months salary if you want me to leave. They said they will provide me with 2 months salary verbally.

But my colleagues are saying they wont do that and I should send them notice about it.

queries

1) If i send a notice would they detoriate my experience or relieving letter.

2) should i wait for full final settlement to happen.

3) should i talk to hr ( have alreday dropped an email but no responses)

4)wat should i do to recover my 2months salary??

Clause in companys offer letter for termination( but this case is after my resignation)

"The company reserves the right to terminate your employment without notice or
payment in lieu of notice period ,for the entire or part of the notice period"

Kindly suggest suitable action .

address a letter to the compnay placing on record the verbal assuarnces given that they would pay you 2 months salary .
in case company refuses to reply or denies the assurances given then issue a legal notice

be polite and firm . dont ruin your relations with the company .

If you have the notice period, the company ought to give you the salary in lieu of that.

Send a letter and if you dont get response then notice.

Yes my advice also deal politely. If its necessary mean issue legal notice to claim your arrears of salary.

Thanks Everyone for your replies.
You guys are really helping guys and spreading awareness .
I would do the following steps

1) Will write down an email to concerned hr and my manager about verbal assurance and notice period clause.

2) If in my full n final setlllement I do not get 2 months salary I would issue a notice.


Let me know If I am going in right direction.
