Hello Experts,
We are a Delhi based Private Limited Company. We are in the process of starting our business in Maharashtra for which we would have to enter into rent agreement for more than 300 Premises.
My query is:-
As such we have a paid up share Capital of more than one crore and hence we are exempted under the Act as stated in Sec 3(1)(b) of Maharashtra rent Control Act, so can we enter into a lease deed for 11 months and do not go for its registration and ignore section 55 of Maharashtra Rent Control Act.
It would be very Difficult to arrange for registration of more than 300 deeds.
Kindly Suggest.

Lease agreement for a period of 11 months does not require registration.

The provisions of Maharashtra Rent Control Act may not be, but there could be other norms governing the contemplated transaction. Please obtain professional advice, given the commercial nature and dimensions of the query.

When you are contemplating to enter into lease agreement for 300 premises, you can as well engage an advocate and pay the fee to settle these matters instead of coming to this expert panel for free advice.

Consult a local lawyer, being a company and going to hire 300 premises, professional advise should be sought from local lawyer.

In Maharashtra State the lease agreement are to be registered compulsorily, this way your contention about non-registration of lease for a period of 11months is a misconception. take the advise of a local lawyer or a consultant with regard to all the formalities involved in this as per the prevailing situation and then proceed safely.
