Application,submitted through proper channel,not forwarded

Sir,

I am working as a regular employee of Central govt(NSSO)

I applied for the post of lecturer in Delhi university(Sent advance copy of the application with all enclosures to the recruiter;and sent a copy of it to my employer for forwarding with a NOC.)

The last date of this recruitment is 28.2.14.The date I sent this application to my employer& recruiter is 19.2.14.On 20.2.14,my employer received this application.

Now,my employer has returned the application to me,not forwarded,stating that they cannot forward it,because it is not sent well in advance.

Dear experts,kindly,advise me whether any legal sanctity is there in their this decision.

7 days time is more than sufficient . your employer must not be wanting to give NOC hence lame excuse given that application not sent in advance

It is well in time.
Employer is bound to give you NOC.

The advance copy is enough for entertaining the application.You can get relieved on selection by the recruiter.Neverthless keep the returned papers so tha to claim later on selection.

Although the discretion lies with the employer not to forward the application to the new recruited, but the reason quoted by your employer to return the application is not genuine. If willing to send, he could even have sent your application late, as your advance copy is meant just to make the recruiter aware of the fact that your application through proper channel would be in the way to reach him any time.

No legal action can be taken against the employer for non-forwarding of the application as the same is a discretionary power of him.

I go by the advise of expert Mr. Isaac Gabriel. Preserve the returned copy of the application so that it can be produced at a later date if there be any dispute in this regard.
