Rti about use of discertionary power by court?

Where govt. uses discretionary power for allotment can we ask for reasons for making such allotment?

There is no illegality of ocassion to escape under the garb of given case bu pracically answer shall be ;according to policy' so you shall have no other option to accept it or to move for further query/information about the relevant policy.

Details of allotments by the use of discretionary power could be asked for under the RTI and it could be obtained. But the reasons....?... Expert Rajkumar has rightly pointed out

In the RTI, you can only ask for 'information' and not 'reasons'.

Further, what is D.V.Rao case?

Can not we ask for note sheets of all files pertaining to allotment made by govt. where it uses discretionary power ?It must be treated as material information in eyes of the judiaciary .

I agree with Mr.Ramachandran. You can ask only existing information not the reasons. Ofcourse file notes/sheets are part of information. You can ask, obtain, assess and come to a conclusion about the use/miuse of discretionary powers.

You can ask any information available on records, including the notes, minutes, members details who decided the allotment etc.
