Non declaration of results by ignou after conducting exam

(Querist) 27 August 2013 This query is : Resolved
My daughter has appeared the exams conducted during June 13 by IGNOU. Application for Exam was submitted in March 13 which was accepted by IGNOU and later on issued Hall Ticket. After attending all exams they have not declared the result with a comment " you are not eligible for this session".

On approaching the Higher authorities they say it is the student's responsibility to check the eligibility and IGNOU is not responsible and they have not replied to any of our letters.

Pl advise.

Issue a legal notice through a lawyer failing which either file a writ petition or a civil suit.

One has to check up whether one is eligible to sit for the examination or not.

If any one, who is not eligible submits an application and the same gets to be accepted, hall ticket issued, exam taken, and later on IF THE NON-ELIGIBILITY COMES TO THE NOTICE, THE RESULT CAN BE WITHHELD AND NEED NOT BE DECLARED.

One cannot take advantage of one's own mistake.

Yes, try your luck through any means, including legal, but the result is a foregone conclusion.

If a candidate was not eligible for the exam, university was justified in not declaring the results. Sometime it is not possible for the university to check the eligibility till exams.

If you wish you may try legal path.

On one hand you say that your daughter had appeared in the exam and on the other you have pointed out about university's statement about the question of her eligibility to appear in the exam. It is not the responsibility of the candidate to check his/her eligibility. If he or she is found ineligible, it is the responsibility of the university to intimate the reason of rejection of his/her application.

It is a matter of commonsense, if she had been issued a hall permit to appear in the exam, she is deemed to have been considered eligible for taking the exam.

If the result has already been declared and your daughter's result held up, issue a notice to the IGNOU to declare the exam. On failure take the university to the court of law.

Is there any chance of misrepresentation of marks / troubling the student by University for remaining exams if we take legal course.

The possibility of manipulation cannot be ruled out.
Sudhir Kumar, Advocate (Expert) 28 August 2013
university is not declaring result because the candidate was not eligible for examination.

you never said whether your daughter was or was not eligible
