Call from women cell

(Querist) 05 April 2014 This query is : Resolved
Dear experts

i have received a call from ASI mahila aayog thana haryana she have informed me that my wife have filed a complain of DV & dowry. The ASI has asked me to meet for counselling with my wife to sort out this matter. i have already filed rcr to bring her back in my genuine intention.

i have confirmed the ASI whether it is an FIR or just a complain then she elaborated that we don't file FIR before 3 counselings
i even requested her to convince my wife to come and stay with me.

She told me to give your presence we will try our best to make things working.

Should i trust this ASI and visit her??

Please advice.

Thanks

RCR was filed in January and she filed complain in march end
Sudhir Kumar, Advocate (Expert) 05 April 2014
you have filed RCR

that means wife is not living with you nor interested in living with you atlest at present. She may be having some reasons (genuine or not) which compels her (atleast as per her perception) that she is not safe or comfortable to live with you.

she filed complaint in mahila police

that means she is well advised how to foil your RCR.

actually filing RCR is almost guaranteed method of inviting complaint (true or not) for dowry demand and domestic violence.

you are hazy about attending the meeting though knowing that failure of councelling will lead to FIR

that me you want an FIR and only then you will defend.

good luck

You could attend ASI counselling and explain your side of version. If any difficulty you could take a local lawyer with you

Take information whether FIR is registered or not. if yes then first take bail and then talk with anyone you choose.
ajay sethi (Expert) 05 April 2014
visit ASi office for counselling . since FIR wont be registered till 3 counselling sessions are over no harm in attending . if FIR filed apply for AB
Rajendra K Goyal (Expert) 06 April 2014
Agree with the expert ajay sethi ji. attend the counseling, if FIR filed try for Anticipatory Bail.
Dr J C Vashista (Expert) 06 April 2014
Agree with the experts, it is an attempt to rconcile on the basis of complaint pending before IO, attend or face the consequency of getting FIR registered against you.
RCR is a useless weapon with you
V R SHROFF (Expert) 06 April 2014
check whether DV 125 filed??? u may say, matter is pending in court.

Unless you agree with her unjstified demand of money, she will file FIR!!be prepared for AB..`
T. Kalaiselvan, Advocate Online (Expert) 06 April 2014
It is better to attend the counseling sessions arranged by the Mahila cell but to be very cautious, please visit the station accompanied by your lawyer so that in case of any trap laid down by the police, you can manage to get away for the time being until you get AB.
